The U.S. Government Renews Jailbreak Exemption, Adds iPad And More

iphone-6-6-plus cyber Monday In recent jailbreak news, the U.S. Library of Congress on Tuesday issued a set of exemptions to the provision of the Digital Millennium Copyright Act (DMCA). The provision makes circumvent restrictions put in place by the maker or manufacturers, but every three years, the Copyright Office has the power to grant exemptions to products and other practices.

In addition, the U.S government not only renewed the ability to jailbreak smartphones, but added tablets to the list. This means it is now legal to jailbreak your iPad. Looking back three years in October, the Register of Copyrights felt that the term “tablet” was too broad to rule on, so it was not included. However, this time around, the Register of Copyrights felt that the category of “all-purpose mobile computing devices” had been well-defined by the EFF and others.

With that said, you can read what Jay Freeman (Saurik) had to say in his tweet about this news, as seen below.

In addition to Freeman’s tweet, you can also read the new DMCA exemptions below.

“Accordingly, based on the Register’s recommendation, the Librarian adopts the following exemption:

Computer programs that enable smartphones and portable all- purpose mobile computing devices to execute lawfully obtained software applications, where circumvention is accomplished for the sole purpose of enabling interoperability of such applications with computer programs on the smartphone or device, or to permit removal of software from the smartphone or device. For purposes of this exemption, a “portable all-purpose mobile computing device” is a device that is primarily designed to run a wide variety of programs rather than for consumption of a particular type of media content, is equipped with an operating system primarily designed for mobile use, and is intended to be carried or worn by an individual.”
