Qualcomm recently filed suit against Apple again, this time with the Beijing’s Intellectual Property Court for patent infringement.
Qualcomm is seeking to stop production and sales on the iPhone in China, this long and costly battle may be with us for a some time. Both companies are suing each other in more than one country, Apple is suing Qualcomm in an Antitrust suit in the United States, Apple is also stating that Qualcomm is charging unfair prices for its technology in the United Kingdom, Japan, Taiwan, and China. Now Qualcomm has taken its case to China claiming patent infringement. If the company is successful against Apple, Apple could be blocked from selling or manufacturing some of its iPhones in China, which of course would cause a major financial set back for Apple.
The Beijing Intellectual Property Court is one of three specialist venues in the Chinese judiciary that has been set-up to rule solely on cases dealing with patents, trademark, and some administrative cases which could involve copyright and unfair competition. The court has the power to issue injunctions and award damages, if by chance an injunction is granted, the consequences would be quite severe for the company that was issued the injunction.
Another alternative to this issue would be for both parties to return back to the negotiation table and reason out their differences, but then that would make them both politically correct in resolving the issue.
